Judge: Man to have no more kids until he supports those he has

ELYRIA — Lorain County Probate Judge James Walther ordered a defendant in a criminal nonsupport case not to have any more children until he can prove he can financially support the ones he already has.

Walther handed down the order to Asim Taylor during a sentencing hearing today. Taylor pleaded guilty last year to charges he failed to pay child support to four children.

He told Taylor to make reasonable efforts to avoid having more children while he is on probation. The ban on more children will be lifted if Taylor can show he’s paid up and current on the child support he owes.

Doug Merrill, Taylor’s lawyer, argued against the procreation ban, saying it violated his client’s rights and effectively forced Taylor to abstain from sex.

“The only way he can ensure not impregnating a woman is not to have sex and I don’t believe the court has the ability to do that,” Merrill said.

But Walther said Taylor needs to take care of the children he has.

“This is a matter of common sense and personal responsibility,” the judge said.
